Where such conditions arise:

  • Additional costs or time implications will be communicated
  • Written approval will be obtained before proceeding

Commercial Construction shall not be responsible for delays or cost increases caused by conditions beyond reasonable prior detection.

6. Project Execution and Client Obligations

6.1 Site Access

Clients must provide safe and reasonable access to the property, including availability of water, electricity, and clear working areas.

6.2 Safeguarding Property

Clients are responsible for securing personal belongings and sensitive materials prior to commencement.

6.3 Delays Beyond Our Control

Delays arising from restricted access, client instructions, supplier shortages, adverse weather, or third-party interference may affect timelines and pricing.

7. Payment Terms

7.1 Structure of Payments

Payment terms will be set out in the quotation or agreement and may include:

  • Deposit requirements
  • Progress payments linked to milestones
  • Final settlement upon completion

7.2 Default

Failure to make payment when due may result in:

  • Suspension of work
  • Retention of materials supplied
  • Recovery proceedings and associated legal costs

Ownership of materials may remain with Commercial Construction until full payment has been received.

8. Standards and Regulatory Compliance

All work is carried out in accordance with recognised commercial construction standards and applicable South African regulations.

9. Workmanship and Limitations

Defects attributable to workmanship must be reported in writing within a reasonable timeframe.

10. Liability and Risk

11. Site Safety and Conduct

We maintain professionally managed worksites in accordance with applicable health and safety standards.

Clients and visitors must:

  • Keep unauthorised persons away from active work areas
  • Follow all reasonable safety instructions

We reserve the right to suspend operations where unsafe conditions exist.

12. Intellectual Property Rights

All website material, branding, written content, graphics, and layouts remain the property of Commercial Construction unless otherwise stated.
